1. DATES IMPORTANTES :

Le concours Secret City Records Barr Brothers Test Pressing Concours (le « concours ») débute le 21 juillet, 2017 à 12:00:00 am. Heure de l’Est (« HE ») et se termine le 11 octobre 2017 à 23:59:59 pm. HE (la « période de concours »).

2. ADMISSIBILITÉ À PARTICIPER :

Le concours est ouvert uniquement aux résidents du Canada et des 50 États-Unis (et le District de Columbia) qui ont atteint l’âge de la majorité dans leur province/territoire/état de résidence au moment de la participation, à l’exception des employés, représentants ou agents (et des personnes vivant sous leur toit, qu’elles soient liées ou non) de Secret City Records Inc. (le « commanditaire »), ses entités affiliées, fournisseurs de prix, agences de publicité/promotion et toute(s) autre(s) personne(s) ou entité(s) impliquée(s) dans la création, la production, la mise en œuvre, l’administration ou la réalisation du concours (collectivement, les « parties au concours  »).

3. LE PARTICIPANT S’ENGAGE À RESPECTER LE RÈGLEMENT DU CONCOURS :

En participant à ce concours, vous consentez expressément à respecter le présent règlement officiel du concours que vous avez lu et vous acceptez d’en être lié (le « règlement »).

4. SPOTIFY NE PARTICIPE PAS :

 Le concours n’est d’aucune façon commandité, cautionné ou administré ou associé à Spotify (la « plateforme sociale »).  La plateforme sociale est par conséquent entièrement dégagée de toute responsabilité par chaque participant à ces concours. Toutes questions, commentaires ou plaintes concernant le concours doivent être adressées directement au commanditaire et non à la plateforme sociale. Vous ne pouvez utiliser qu’un (1) compte Spotify un « compte ») pour participer à ce concours. Pour être admissible à gagner une participation (chacune, une « participation » et collectivement, des « participations ») à ce concours, votre compte doit être « public » et non privé.

5. COMMENT PARTICIPER :

AUCUN ACHAT REQUIS. EFFECTUER UN ACHAT N’AUGMENTERA PAS OU N’AURA AUCUN EFFET QUE CE SOIT SUR VOS CHANCES DE GAGNER CE CONCOURS. Vous pouvez gagner une (1) participation, comme suit :

Spotify : Pour participer en utilisant Spotify, vous devez tout d’abord consulter http://presave.tweematic.com/thebarrbrothers, cliquez sur ‘Entrez pour gagner une copie de test-pressing signé’ et suivez les instructions à l’écran pour vous connecter dans votre compte (si vous n’êtes pas déjà connecté dans votre compte). Ensuite, vous devrez cliquez sur ‘Suivez The Barr Brothers Spotify’ et (entre autres choses) : (i) Pré-enregistrez ‘Queens of the Breakers’ de The Barr Brothers à votre bibliothèque de Spotify (Remarque : vous pouvez, sans réduire vos chances de gagner le concours, supprimer votre album de votre bibliothèque Spotify en tout temps après : (a) la fin de la période de concours; et (b) lorsque l’album apparaît dans votre bibliothèque Spotify); et (ii) devenir un « suiveur » de The Barr Brothers sur Spotify (Remarque : vous pouvez cesser de suivre en tout temps après la fin du concours sans réduire vos chances de gagner). Durant ce processus, vous devrez fournir certaines informations personnelles (c.à.d. le nom et l’adresse de courriel). Lorsque toutes les étapes du processus de participation sont complétées, vous serez automatiquement admissible à gagner une (1) participation au concours. Pour être admissible, votre participation doit avoir été soumise et reçue en conformité au présent règlement durant la période de concours.

6. LIMITE DE PARTICIPATION ET CONDITIONS :

Il y a une limite d’une (1) participation par personne (peu importe le mode de participation).  S’il est détecté par le commanditaire (avec une preuve ou en utilisant tout autre renseignement disponible ou autrement détecté par le commanditaire) que toute personne a tenté : (i) d’obtenir plus d’une (1) participation (peu importe le mode de participation); et/ou (ii) d’utiliser plusieurs noms, identités, adresses de courriel, comptes, tout programme informatisé, macro-programme, programme script, programme robotique or autre(s) système(s) ou programme(s) et/ou tous autres moyens non-conformes à l’interprétation du commanditaire de la lettre/esprit du présent règlement pour s’inscrire ou autrement pour participer à ou à nuire au alors il/elle pourra être disqualifié(e) du concours, à l’entière et absolue discrétion du commanditaire.  Les parties au concours, Spotify, et chacun de leurs agents respectifs, employés, dirigeants, successeurs, et ayants droit (collectivement, les « parties renonciataires ») ne sont pas être tenues responsables, de quelque façon que ce soit, de toutes participations parvenues en retard, perdues, mal acheminées, retardées, incomplètes ou incohérentes (lesquelles seront toutes annulées).

7. VÉRIFICATION :

Toutes les participations et participants sont assujettis à la vérification en tout temps et pour toute raison. Le commanditaire se réserve le droit, à son entière et absolue discrétion, d’exiger une preuve d’identité et/ou d’admissibilité (sous une forme acceptable pour le commanditaire – y compris, mais non exclusivement, une carte d’identité à photo émise par le gouvernement) : (i) afin de vérifier l’admissibilité d’une personne à participer à ce concours; (ii) afin de vérifier l’admissibilité et/ou la légitimité de toute participation et/ou autres renseignements fournis (ou prétendument inscrits) aux fins de ce concours; et/ou (iii) toute autre raison jugée nécessaire par le commanditaire, à son entière et absolue discrétion, afin d’administrer le concours conformément à l’interprétation du commanditaire de la lettre et à l’esprit du présent règlement. Tout manquement à fournir telle preuve, à l’entière satisfaction du commanditaire et dans le délai précisé par le commanditaire peut entraîner une disqualification, et ce, à l’entière et absolue discrétion du commanditaire.  Le temps officiel de ce concours sera déterminé au moyen de(s) horloge(s) officielle(s) du commanditaire.

8. PRIX :

Il n’y aura qu’un (1) prix (le « prix ») à gagner.  Le prix consiste à un (1) test-pressing vinyle signé par The Barr Brothers. Le prix a une valeur au détail approximative de 50 $ (CAD) / ($39 (USD)

REMARQUE IMPORTANTE : TOUS AUTRES COÛTS ASSOCIÉS À L’UTILISATION DU PRIX SERONT À L’ENTIÈRE ET ABSOLUE RESPONSABILITÉ DU GAGNANT. AUCUNE DES PARTIES RENONCIATAIRES, NI AUCUNE AUTRE ENTITÉE, NE FOURNIRA AUCUNE INDEMNISATION QUE CE SOIT À L’ÉGARD DE TOUS COÛTS ASSOCIÉS À L’UTILISATION DU PRIX OU AUTREMENT.

Le prix doit être accepté tel qu’attribué et ne peut pas être transféré, ni cédé ou converti en argent comptant (à l’exception tel que spécifiquement permis par le commanditaire, à son entière et absolue discrétion). Aucune substitution n’est permise, à l’exception au choix du commanditaire).  Le commanditaire se réserve le droit, à son entière et absolue discrétion, de substituer le prix ou une composante de celui-ci par un prix d’une valeur au détail égale ou supérieure, incluant, sans limitation, mais à l’entière et absolue discrétion du commanditaire, par un montant en argent comptant.

Aucune des parties renonciataires ne fait de représentations ni n’offre aucune garantie, expresse ou implicite, de la qualité ou de l’adéquation de tout prix attribué dans le cadre de ce concours. Dans toute la mesure permise par la loi applicable, chaque gagnant confirmé comprend et reconnaît qu’il ou elle ne peut pas demander de remboursement ou intenter toute poursuite judiciaire ou tous recours contre le commanditaire ni contre aucune partie renonciataire dans le cas où le prix applicable ne lui conviendrait pas ou ne lui serait d’aucune façon satisfaisant. Afin de dissiper tout doute, en acceptant un prix, chaque gagnant confirmé accepte de renoncer à tous recours contre les parties renonciataires si le prix ou une partie de celui-ci n’est pas satisfaisant, en tout ou en partie.

Résidents des États-Unis : Le gagnant est responsable de toutes taxes et frais associés à la réception et/ou l’utilisation du prix. Toutes les responsabilités fédérales, d’état et locales, aussi bien que tous autres frais et dépenses qui ne sont pas spécifiés aux présentes sont l’entière responsabilité du gagnant. Le gagnant peut devoir remplir et retourner le formulaire IRS W-9 (c.à.d. la demande du numéro d’identification du contribuable et d’attestation).

9. PROCESSUS DE SÉLETION DU GAGNANT ADMISSIBLE :

Le 20 octobre 2017 (la « date de sélection ») à Montréal au Québec à environ 14 h HE, un (1) participant admissible pour chaque prix sera sélectionné par tirage au sort parmi toutes les participations admissibles soumises et reçues en conformité au présent règlement.  Les chances de gagner dépendent du nombre de participations admissibles soumises et reçues en conformité au présent règlement.

10. PROCESSUS DE NOTIFICATION DU GAGNANT ADMISSIBLE : 

Le commanditaire ou son représentant tentera à au moins trois (3) reprises de contacter le gagnant admissible dans les deux (jours ouvrables suivant la date de sélection. Si l’on ne parvient pas à joindre un gagnant admissible dans les deux (2) jours ouvrables de la date de sélection, ou si une notification nous a été retournée comme étant non livrable, alors il/elle pourra, à l’entière et absolue discrétion du commanditaire, être disqualifié(e) (et, le cas échéant, se verra retirer tous droits au prix applicable) et le commanditaire se réserve le droit, à son entière et absolue discrétion et si le temps le permet, de sélectionner un autre participant admissible parmi le reste des participations admissibles soumises et reçues en conformité aux procédures indiquées à l’article 9 du présent règlement (auquel cas les dispositions précédentes du présent article seront applicables au nouveau gagnant admissible sélectionné).

11. PROCESSUS DE CONFIRMATION DU GAGNANT ADMISSIBLE :

personne n’Est UN GAGNANT JUSQU’À CE QU’IL SOIT DÉCLARÉ GAGNANT PAR LE COMMANDITAIRE en conformité au présent règlement. AVANT D’ÊTRE DÉCLARÉ UN GAGNANT CONFIRMÉ DU PRIX, le gagnant admissible devra : (a) répondre correctement à une question d’habileté mathématique sans aide mécanique ou autre (qui peut, à l’entière et absolue discrétion du commanditaire, être administrée en ligne, par courriel ou par d’autres moyens électroniques, par téléphone ou dans le formulaire de déclaration et de quittance du commanditaire) (uniquement requis pour les résidents canadiens); et (b) signer et retourner le formulaire de déclaration et quittance du commanditaire dans les deux (2) jours ouvrables de la notification du commanditaire, qui (entre autres choses) : (i) confirme sa conformité au présent règlement; (ii) reconnaît avoir accepté de prix applicable (tel qu’attribué); et (iii) dégage les parties renonciataires de toute responsabilité à l’égard du présent concours, de sa participation audit concours et/ou de l’attribution et de l’utilisation/du mauvais usage du prix applicable ou de toute composante de celui-ci.

Si le gagnant admissible : (a) omet de répondre correctement à la question d’habilité mathématique, le cas échéant; (b) omet de retourner les documents de concours dûment remplis dans le temps imparti; (c) ne peut pas (ou ne veut pas) accepter le prix applicable (tel qu’attribué) pour toute raison; et/ou (d) est jugé avoir enfreint le présent règlement (le tout tel qu’établi par le commanditaire, à son entière et absolue discrétion; alors, il/elle sera alors disqualifié(e) (et, le cas échéant, se verra retirer tous droits au prix) et le commanditaire se réserve le droit, à son entière et absolue discrétion et si le temps le permet, de sélectionner par tirage au sort un autre participant admissible parmi le reste des participations admissibles soumises et reçues en conformité aux procédures indiquées à l’article 9 du présent règlement (auquel cas les dispositions précédentes du présent article seront applicables au nouveau gagnant admissible sélectionné).

12. CONDITIONS GÉNÉRALES :

Ce concours est assujetti à toutes les lois et fédérales, d’état, provinciales et municipales applicables. Les décisions du commanditaire concernant tous les aspects de ce concours sont finales et sans appel, et ont force exécutoire pour tous les participants.

QUICONQUE A, DE L’AVIS DU COMMANDITAIRE, ENFREINT LA LETTRE ET/OU L’ESPRIT DU PRÉSENT RÈGLEMENT, POUR QUELQUE RAISON QUE CE SOIT, PEUT ÊTRE DISQUALIFIÉ, ET CE, À L’ENTIÈRE ET ABSOLUE DISCRÉTION DU COMMANDITAIRE, ET EN TOUT TEMPS.

Les parties renonciataires ne seront pas être tenues responsables de : (i) tout manquement de tout site web ou toute plateforme durant le concours; (ii) toute défaillance technique ou autres problèmes de quelque nature que ce soit, y compris, mais non exclusivement, liés à l’utilisation de lignes ou de réseaux téléphoniques, de systèmes informatiques en ligne, de serveurs, de fournisseurs d’accès internet, d’ordinateur ou de programme ou équipement informatique; (iii) tout manquement à toute participation, documents de participation et/ou autres renseignements à être reçus, enregistrés ou adéquatement traités, pour toute raison que ce soit, y compris, mais sans s’y limiter, tous problèmes techniques ou congestion du trafic sur internet ou sur tout site web; (iv) toute blessure ou dommage à un ordinateur de participant ou à toute autre personne ou d’un autre appareil relié ou résultant de la participation au concours; (v) toute personne étant identifiée comme gagnant ou gagnant admissible, incorrectement et/ou par erreur; et/ou (vi) toute combinaison de ce qui précède.

Le commanditaire se réserve le droit, subordonné uniquement à l’approbation de la Régie des alcools, des courses et des jeux (la « Régie ») au Québec, de retirer, de modifier ou de suspendre ce concours (ou de modifier le présent règlement), de quelque façon que ce soit, dans le cas de toute cause échappant au contrôle raisonnable du commanditaire qui interfère avec le bon déroulement du concours tel que prévu au présent règlement, y compris, sans limitation, advenant toute(s) erreur(s), problème(s) technique(s), virus informatique(s) et bogue(s), un trafiquage, une intervention non autorisée, une fraude ou défaillance(s) technique(s), quels qu’ils soient. Toute tentative de nuire au déroulement légitime de ce concours, de quelque façon que ce soit (tel qu’établi par le commanditaire, à son entière et absolue discrétion) peut être une infraction au code criminel et au droit civil, et, advenant telle tentative, le commanditaire se réserve le droit d’intenter un recours en dommages-intérêts dans toute la mesure permise par la loi.  Le commanditaire se réserve le droit, sous réserve de l’approbation de la Régie au Québec, d’annuler, de modifier ou de suspendre ce concours, ou d’en modifier le présent règlement, de quelque manière que ce soit, sans préavis ni obligation, en cas d’accident, d’erreur d’impression, d’erreur administrative, ou de toute autre nature, quelle qu’elle soit, ou pour toute autre raison.  Le commanditaire se réserve le droit, à son entière et absolue discrétion, d’administrer une autre question réglementaire, s’il le juge approprié, selon les circonstances et/ou afin de respecter la loi applicable.

En participant à ce concours, chaque participant consent expressément à ce que le commanditaire, ses mandataires et/ou représentants, puissent stocker, partager et utiliser les renseignements personnels soumis avec ses documents de participation, uniquement à des fins d’administration du présent concours, et ce, conformément à la politique de confidentialité du commanditaire. Cette section ne limite pas tous autre(s) consentement(s) qu’une personne peut fournir au commanditaire ou autres personnes à la collection, l’utilisation et/ou la divulgation de ses renseignements personnels.

Le commanditaire se réserve le droit, sous réserve de l’approbation de la Régie au Québec, de rectifier des dates, périodes de temps et/ou autres questions administratives du concours énoncées dans le présent règlement, jugées nécessaires par le commanditaire, aux fins de vérifications de tout participant, participation, documents de participation et/ou tous autres renseignements conformément au présent règlement, ou à cause de problèmes techniques ou autres, ou dans toutes autres circonstances qui, de l’avis du commanditaire, et à son entière et absolue discrétion, nuisent au bon déroulement du concours tel que prévu au présent règlement, ou pour toute autre raison.

Résidents du Québec : Tout litige concernant le déroulement ou l’organisation d’un concours peut être soumis à la Régie des alcools, des courses et des jeux dans le but d’obtenir une décision. Tout litige concernant l’attribution d’un prix peut être soumis à la Régie, seulement dans le but d’aider les parties à conclure une entente.

Advenant toute divergence ou discordance entre les termes et conditions de la version anglaise du présent règlement et les divulgations ou autres énoncés contenus dans tous documents promotionnels, y compris, mais sans s’y limiter, et la version française du présent règlement, de la publicité et/ou de toutes instructions ou interprétations du présent règlement, au point de vente, à la télévision, imprimées ou en ligne effectuées par tous représentants du commanditaire, les termes et conditions de la version anglaise du présent règlement auront préséances, seront applicables et assureront la régularisation de la promotion, dans toute la mesure permise par la loi.  L’invalidité ou la non-exécution de toute disposition du présent règlement n’affectera en rien la validité ou la force exécutoire de toute autre disposition. Advenant le cas où l’une ou l’autre des dispositions du présent règlement s’avérerait non valide ou par ailleurs inexécutable ou illégale, le présent règlement demeurera en vigueur et sera alors interprété conformément à ses conditions inhérentes, comme si la disposition non valide ou illégale n’y figurait pas.  Dans toute la mesure permise par la loi applicable, tous problèmes et questions concernant l’élaboration, la validité, l’interprétation et l’applicabilité du présent règlement ou les droits et obligations des participants, le commanditaire ou toutes autres parties renonciataires dans le cadre de ce concours, seront régis et interprétés en vertu des lois de la province de Québec et des lois fédérales applicables du Canada à cet égard, sans donner effet à aucune loi ou conflit de lois ou dispositions, qui auront pour effet de rendre applicables les lois d’une autre juridiction. Par les présentes, les parties consentent à la juridiction exclusive et territoriale des tribunaux situés au Québec pour toute action visant à faire respecter (ou autrement lié à) ce règlement ou se rapportant à ce concours.

13. RÉSULTATS DU CONCOURS:

Pour obtenir les résultats du concours, veuillez envoyer un courriel en indiquant dans son entête : « Liste des gagnants – Secret City Records », à l’adresse de courriel : info@secretcityrecords.com. Les demandes pour obtenir la liste des gagnants doivent être reçues dans un délai de 60 jours de la fin de la période de concours.

1. KEY DATES:

The Secret City Records Barr Brothers Test Pressing Contest (the “Contest”) begins on July 21, 2017 at 12:00:00 a.m. Eastern Time (“ET”) and ends on October 11, 2017 at 11:59:59 p.m. ET (the “Contest Period”).

2. ELIGIBILITY TO ENTER:

The Contest is open only to residents of Canada and the 50 United States (and the District of Columbia) who have reached the legal age of majority in their province/territory/state of residence at the time of entry, except employees, representatives or agents (and those with whom such persons are living, whether related or not) of Secret City Records Inc. (the “Sponsor”), its affiliated entities, prize suppliers, advertising/promotion agencies and any other individual(s), entity or entities involved in the development, production, implementation, administration or fulfillment of the Contest (collectively, the “Contest Parties”).

3. AGREEMENT TO BE LEGALLY BOUND BY RULES:

By participating in this Contest, you are signifying your agreement that you have read and agree to be legally bound by these Official Rules and Regulations (the “Rules”).

4. SPOTIFY NOT INVOLVED:

The Contest is in no way sponsored, endorsed or administered by, or associated with Spotify (the “Social Platform”).  The Social Platform is hereby completely released of all liability by each entrant in this Contest.  Any questions, comments or complaints regarding the Contest must be directed to the Sponsor and not to the Social Platform.  You may only use one (1) Spotify Account (an “Account”) to participate in this Contest. To be eligible to earn an Entry (each, an “Entry” and collectively, the “Entries”) in this Contest, your Account must be set to public and not private.

5. HOW TO ENTER:

No purchase necessary.  MAKING A PURCHASE WILL NOT INCREASE OR OTHERWISE IMPACT YOUR CHANCES OF WINNING IN THIS CONTEST. You can earn a maximum of one (1) Entry, as follows:

Spotify: To enter via Spotify, you must first visit http://presave.tweematic.com/thebarrbrothers, click on “Enter To Win A Signed Test Pressing” and follow the on-screen instructions to log-in to your Account (if you are not already logged in to your Account). Next, you will be required to click on “Pre-Save Spotify” to (among other things): (i) Pre-Save the upcoming album by The Barr Brothers entitled “Queens of the Breakers” (the “Album”) to your library on Spotify (Note: you can, without impacting your chances of winning the Contest, remove the Album from your Spotify library at any time after the later of: (a) the end of the Contest Period; and (b) when the Album appears in your Spotify library); and (ii) become a “follower” of the The Barr Brothers on Spotify (Note: you can un-follow at any time after the Contest ends without impacting your chances of winning). During this process, you will be required to provide certain personal information (e.g. your name and email address). When all required steps of the entry process are complete, you will automatically be eligible to earn one (1) Entry in the Contest. To be eligible, your Entry must be submitted and received in accordance with these Rules during the Contest Period.

6. ENTRY LIMIT AND CONDITIONS: 

There is a limit of one (1) Entry per person (regardless of the method of entry).  If it is discovered by the Sponsor (using any evidence or other information made available to or otherwise discovered by the Sponsor) that any person has attempted to: (i) obtain more than one (1) Entry (regardless of the method of entry); and/or (ii) use multiple names, identities, email addresses, Accounts, any automated, macro, script, robotic or other system(s) or program(s), and/or any other means not in keeping with the Sponsor’s interpretation of the letter and spirit of these Rules to enter or otherwise participate in or to disrupt this Contest; then he/she may be disqualified from the Contest in the sole and absolute discretion of the Sponsor.  The Contest Parties, Spotify, and each of their respective agents, employees, directors, successors, and assigns (collectively, the “Released Parties”) are not responsible for, and accept no liability whatsoever in relation to, any late, lost, misdirected, delayed, incomplete or incompatible Entries (all of which are void).

7. VERIFICATION:

All Entries and entrants are subject to verification at any time and for any reason.  The Sponsor reserves the right, in its sole and absolute discretion, to require proof of identity and/or eligibility (in a form acceptable to the Sponsor – including, without limitation, government issued photo identification): (i) for the purposes of verifying an individual’s eligibility to participate in this Contest; (ii) for the purposes of verifying the eligibility and/or legitimacy of any Entry and/or other information entered (or purportedly entered) for the purposes of this Contest; and/or (iii) for any other reason the Sponsor deems necessary, in its sole and absolute discretion, for the purposes of administering this Contest in accordance with the Sponsor’s interpretation of the letter and spirit of these Rules.  Failure to provide such proof to the complete satisfaction of the Sponsor within the timeline specified by the Sponsor may result in disqualification in the sole and absolute discretion of the Sponsor.  The sole determinant of the time for the purposes of this Contest will be the official time-keeping device(s) of the Sponsor.

8. PRIZE:

There will be one (1) Prize (the “Prize”) available to be won.  The Prize consists of one (1) signed test pressing of The Barr Brothers album ‘Queens of the Breakers’. The Prize has an approximate retail value of $50 (CDN) or $39 (USD)

IMPORTANT NOTE:  ANY AND ALL OTHER COSTS ASSOCIATED WITH UTILIZING THE PRIZE WILL BE THE SOLE AND ABSOLUTE RESPONSIBILITY OF THE WINNER.  NONE OF THE RELEASED PARTIES, NOR ANY OTHER ENTITY, WILL BE PROVIDING ANY COMPENSATION WHATSOEVER WITH RESPECT TO ANY COSTS ASSOCIATED WITH UTILIZING THE PRIZE OR OTHERWISE.

Prize must be accepted as awarded and is not transferable, assignable or convertible to cash (except as may be specifically permitted by Sponsor in its sole and absolute discretion).  No substitutions except at Sponsor’s option.  Sponsor reserves the right, in its sole and absolute discretion, to substitute the Prize or a component thereof with a prize of equal or greater retail value, including, without limitation, but at Sponsor’s sole and absolute discretion, a cash award.

None of the Released Parties makes any representation or offers any warranty, express or implied, as to the quality or fitness of the Prize awarded in connection with the Contest. To the fullest extent permitted by applicable law, the confirmed winner understands and acknowledges that he or she may not seek reimbursement or pursue any legal or equitable remedy from either the Sponsor nor any of the other Released Parties should his/her Prize fail to be fit for its purpose or is in any way unsatisfactory. For greater certainty and the avoidance of any doubt, by accepting the Prize, the confirmed winner agrees to waive all recourse against the Sponsor and all of the other Released Parties if his/her Prize or a component thereof does not prove satisfactory, either in whole or in part.

For US Residents: Winner is responsible for all taxes and fees associated with prize receipt and/or use. All federal, state, and local tax liabilities, as well as any other costs and expenses not specified herein as being awarded are the sole responsibility of the Winner. Winner may be required to complete and return an IRS W-9 form (i.e. Request for Taxpayer Identification Number and Certification).

9. ELIGIBLE WINNER SELECTION PROCESS:

On October 20, 2017 (the “Selection Date”) in Montreal, QC at approximately 2:00 p.m. ET, one (1) eligible entrant will be selected by random draw from among all eligible Entries submitted and received in accordance with these Rules.  The odds of winning depend on the number of eligible Entries submitted and received in accordance with these Rules.

10. ELIGIBLE WINNER NOTIFICATION PROCESS: 

The Sponsor or its designated representative will make a minimum of three (3) attempts to contact the eligible winner within two (2) business days of the Selection Date.  If the eligible winner cannot be contacted within two (2) business days of the Selection Date, or if there is a return of any notification as undeliverable; then he/she may, in the sole and absolute discretion of the Sponsor, be disqualified (and, if disqualified, will forfeit all rights to the Prize) and the Sponsor reserves the right, in its sole and absolute discretion and time permitting, to randomly select an alternate eligible entrant for the Prize from among the remaining eligible Entries submitted and received in accordance with these Rules in accordance with the procedures outlined in Rule 9 (in which case the foregoing provisions of this section shall apply to such newly selected eligible winner).

11. ELIGIBLE WINNER CONFIRMATION PROCESS:

NO ONE IS A WINNER UNLESS AND UNTIL THE SPONSOR OFFICIALLY CONFIRMS HIM/HER AS THE WINNER IN ACCORDANCE WITH THESE RULES.  Before being declared A CONFIRMED PRIZE winner, the eligible winner will be required to: (a) correctly answer a mathematical skill-testing question without mechanical or other aid (which may, in the sole and absolute discretion of the Sponsor, be administered online, by email or other electronic means, by telephone, or in the Sponsor’s form of declaration and release) (only required for Canadian residents); and (b) sign and return within two (2) business days of notification the Sponsor’s declaration and release form, which (among other things): (i) confirms compliance with these Rules; (ii) acknowledges acceptance of the Prize (as awarded); and (iii) releases the Released Parties from any and all liability in connection with this Contest, his/her participation therein and/or the awarding and use/misuse of the Prize or any portion thereof.

If the eligible winner: (a) fails to correctly answer the skill-testing question, if applicable; (b) fails to return the properly executed Contest documents within the specified time; (c) cannot accept (or is unwilling to accept) the Prize (as awarded) for any reason; and/or (d) is determined to be in violation of these Rules (all as determined by the Sponsor in its sole and absolute discretion); then he/she will be disqualified (and will forfeit all rights to the Prize) and the Sponsor reserves the right, in its sole and absolute discretion and time permitting, to randomly select an alternate eligible entrant for the Prize from among the remaining eligible Entries submitted and received in accordance with these Rules in accordance with the procedures outlined in Rule 9 (in which case the foregoing provisions of this section shall apply to such newly selected eligible winner).

12. GENERAL CONDITIONS:

This Contest is subject to all applicable federal, provincial, state and municipal laws.  The decisions of the Sponsor with respect to all aspects of this Contest are final and binding on all entrants without right of appeal.

ANYONE DEEMED BY THE SPONSOR TO BE IN VIOLATION OF THE SPONSOR’S INTERPRETATION OF THE LETTER AND/OR SPIRIT OF THESE RULES FOR ANY REASON IS SUBJECT TO DISQUALIFICATION IN THE SOLE AND ABSOLUTE DISCRETION OF THE SPONSOR AT ANY TIME.

The Released Parties will not be liable for: (i) any failure of any website or any platform during the Contest; (ii) any technical malfunction or other problems of any nature whatsoever, including, without limitation, those relating to the telephone network or lines, computer on-line systems, servers, access providers, computer equipment or software; (iii) the failure of any Entry and/or other information to be received, captured or recorded for any reason whatsoever, including, but not limited to, technical problems or traffic congestion on the internet or at any website; (iv) any injury or damage to an entrant’s or any other person’s computer or other device related to or resulting from participating in the Contest; (v) anyone being incorrectly and/or mistakenly identified as a winner or eligible winner; and/or (vi) any combination of the above.

The Sponsor reserves the right, subject only to the approval of the Régie des alcools, des courses et des jeux (the “Régie”) in Quebec, to withdraw, amend or suspend this Contest (or to amend these Rules) in any way, in the event of any cause beyond the reasonable control of the Sponsor that interferes with the proper conduct of this Contest as contemplated by these Rules, including, without limitation, any error, problem, computer virus, bugs, tampering, unauthorized intervention, fraud or failure of any kind whatsoever.  Any attempt to undermine the legitimate operation of this Contest in any way (as determined by Sponsor in its sole and absolute discretion) may be a violation of criminal and civil laws and should such an attempt be made, the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law.  The Sponsor reserves the right, in its sole and absolute discretion, to cancel, amend or suspend this Contest, or to amend these Rules, in any way without prior notice or obligation, in the event of any accident, printing, administrative, or other error of any kind, or for any other reason whatsoever.  The Sponsor reserves the right, subject only to the approval of the Régie in Quebec, to administer an alternate test of skill as it deems appropriate based on the circumstances and/or to comply with applicable law.

By entering this Contest, each entrant expressly consents to the Sponsor, its agents and/or representatives, storing, sharing and using the personal information submitted only for the purpose of administering the Contest and in accordance with Sponsor’s privacy policy.  This section does not limit any other consent(s) that an individual may provide the Sponsor or others in relation to the collection, use and/or disclosure of their personal information.

The Sponsor reserves the right, subject only to the approval of the Régie in Quebec, to adjust any of the dates, timeframes and/or other Contest mechanics stipulated in these Rules, to the extent deemed necessary by Sponsor, for purposes of verifying compliance by any entrant, Entry and/or other information with these Rules, or as a result of any technical or other problems, or in light of any other circumstances which, in the opinion of the Sponsor, in its sole and absolute discretion, affect the proper administration of the Contest as contemplated in these Rules, or for any other reason.

For Quebec Residents:  Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of a prize may be submitted to the board only for the purpose of helping the parties reach a settlement.

In the event of any discrepancy or inconsistency between the terms and conditions of these English Rules and disclosures or other statements contained in any Contest-related materials, including, but not limited to, the French version of these Rules, point of sale, television, print or online advertising and/or any instructions or interpretations of these Rules given by any representative of the Sponsor, the terms and conditions of these Rules shall prevail, govern and control to the fullest extent permitted by law.  The invalidity or unenforceability of any provision of these Rules shall not affect the validity or enforceability of any other provision.  In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Rules shall otherwise remain in effect and shall be construed in accordance with the terms as if the invalid or illegal provision were not contained herein.  To the fullest extent permitted by applicable law, all issues and questions concerning the construction, validity, interpretation and enforceability of these Rules or the rights and obligations of participants, Sponsor or any of the other the Released Parties in connection with the Contest will be governed by and construed in accordance with the domestic laws of the Province of Quebec and the federal laws of Canada applicable therein, without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other jurisdiction’s laws.  The parties hereby consent to the exclusive jurisdiction and venue of the courts located in Quebec in any action to enforce (or otherwise relating to) these Rules or relating to this Contest.

13. CONTEST RESULTS

For Contest results, send an email with the subject line of “Winners List – Secret City Records” to info@secretcityrecords.com. Requests for the Winner’s List must be received within 60 days of the end of the Contest Period.
